Factors that influence child custody decisions

On Behalf of Law Offices of Andrew S. Guisbond | Jul 29, 2022 | Child Custody |

If you want to end your marriage and you have kids, or you are currently working through a divorce and a dispute involving your children has arisen, it is vital to review various factors related to child custody. When awarding child custody, courts take a host of issues into consideration.

It is crucial to understand how these factors could affect your ability to secure custody or visitation rights.

Custody decisions and a child’s best interests

Mass.gov goes over some of the factors that courts analyze when trying to make custody decisions that serve the best interests of a child. For example, courts will look at a child’s performance in school, their well-being and their relationship with each parent and other relatives. If one parent has previously acted as the child’s primary caregiver, this could affect a custody decision. Moreover, a child can also influence a custody decision, depending on the child’s maturity and age.

Courts also take a parent’s track record of drug abuse, abandonment and child abuse into account. Unfortunately, some parents falsely accuse the other party of abuse or wrongdoing in order to gain the upper hand in a custody dispute.

Working through a dispute involving child custody

Child custody cases tend to generate strong emotions, and some parents feel overwhelmed with anxiety or even hopeless. You need to remain focused on your custody case, and do everything in your power to safeguard the best interests of your children as well as your relationship with them. Make sure you gather evidence and strive for a favorable outcome with respect to child custody and other divorce-related matters.
