What are the legal options for custody agreement violations?

On Behalf of Law Offices of Andrew S. Guisbond | Feb 26, 2025 | Child Custody |

Co-parenting can be challenging, especially when one parent refuses to follow a custody agreement. These violations can create stress for both the child and the other parent. If a co-parent repeatedly ignores the custody order, legal steps may be necessary to protect parental rights and maintain stability for the child.

Document each violation

Keeping a detailed record of custody violations is crucial. This includes dates, times, and descriptions of missed exchanges, late pickups, or denied visitation. If possible, save text messages, emails, or voicemails that show the other parent’s failure to follow the agreement. These records provide evidence if legal action becomes necessary

Communicate with the co-parent

Addressing the issue directly can sometimes resolve the problem. A calm and respectful conversation may help clarify misunderstandings and encourage cooperation. If speaking in person is not effective or safe, communication can take place through email, text messages, or a co-parenting app. Written communication also creates a record of attempts to resolve conflicts.

Seek mediation or legal assistance

If custody violations continue, mediation may be a useful next step. A neutral third party can help parents work through disputes and reinforce the importance of following the agreement. In some cases, an attorney may be needed to send a formal letter reminding the co-parent of their legal obligations.

File a motion for enforcement

When informal efforts fail, the court can enforce the custody order. A motion for enforcement asks a judge to review the situation and take action. Courts may impose fines, require make-up parenting time, or modify custody arrangements if violations persist.

Protect the child’s well-being

Repeated custody violations can affect a child’s emotional health. A stable and consistent routine benefits children, and parents should offer reassurance and support. If needed, professional counseling can help children cope with the stress caused by ongoing conflicts.

Taking action against custody violations ensures that the child’s best interests remain the priority. Consistency and legal enforcement help maintain a structured and healthy co-parenting arrangement.
