When does parental relocation become parental abduction?

When parents separate, custody arrangements outline each parent’s rights and duties for their child. These plans ensure a child’s stable and healthy upbringing. A parent wanting to move sometimes creates complex legal questions, especially if the move takes the child a long way.

Is it relocation or an abduction?

A parent’s move turns into abduction if one parent takes a child without the other parent’s permission or a court order. In Massachusetts, if parents share legal custody, neither parent can move the child out of state alone. The dangers of moving without permission

When a parent moves a child without court approval or the other parent’s agreement, they face harsh penalties. Aside from the courts ordering the child to be returned immediately, a parent may lose custody and even face criminal charges.
